Upcoming auction of seized coal in West Jaintia Hills: Interested parties invited to bid
The Deputy Commissioner of West Jaintia Hills District issued a notice on December 19, announcing the auction of seized coal in accordance with the order from the Chief Judicial Magistrate, West Jaintia Hills District, Jowai/Special Judge (MMDR Act, 1957) Jowai Court. The auction involves cases initiated by I/O SI A.R Marak Phramer Traffic Cell and OC B.R. Marak, Amlarem Police Station, West Jaintia Hills District. The details of the coal to be auctioned, as per various court orders, are as follows:
- Vide Court Order G.R Case No.198/16 U/S 188 IPC r/w Sec 3(2)(d) PDPP 15 MT vide seizure list bearing MR. No. 319/2016 and 15 MT vide seizure list bearing MR. No.320/2016 in the instant case and Lying at Phramer Traffic cell = Total 30 MT.
- Vide Court Order of the Chief Judicial Magistrate— G.R. No. 63/2016 U/S 188 IPC r/w Sec.3(2)(d) PDPP Act
(i) 13 MT vide seizure list bearing MR.No. 203/2016
(ii) 12 MT vide seizure list bearing MR.No. 204/2016
(iii) 12 MT vide seizure list bearing MR.No. 205/2016
(iv) 3 MT vide seizure list hearing MR.No. 206/2016
(Total =40 MT.) - Vide Court Order of the Chief Judicial Magistrate-G.R. No. 141/2016 U/S 379/188 IPC r/w Section.3(2)(d) PDPP Act— 10 MT lying at Phramer Traffic cell.

- Court of the Chief Judicial Magistrate—G.R. No. 218/2017 U/S 188/34 IPC Sec.3(2)(d) PDPP Act– 18 MT lying at Phramer Traffic cell.
- Vide Ref. Jowai PS C/No.37(3)2020, U/S 188/34 PC R/W sec 21 MMDR Act. Coal seized was and around 45700 MT, stocked at the premises of the Police Reserve, Jowai
- Vide Ref. Jowai PS C/No.172 (2)2018, U/S 188/34 IPC R/W sec 21 MMDR Act. Coal seized was around 24 MT. stocked at the premises of the Phramer Traffic Cell.
- Vide Ref. Jowai PS C/No.30 (03)2022 U/S 21 MMDR, MMDR Act. Coal seized was around 21.12 MT. stocked at the premises of the Phramer Traffic Cell
- Vide Ref. Jowai PS C/No.2 (3)2022, U/S 188/34 IPC R/W 21 (5) MMDR Act. Coal seized was and around 1031 MT. located at Shkentalang and its adjoining area.
Therefore, interested parties may accordingly submit bids as per Terms & Conditions laid down.
Terms and Conditions:
- Any interested bidder may submit their bid application in plain paper by affixing the Court Fee stamp of Rs 1000/- (Rupees One Thousand) Only. The Bid is to be accompanied with the photocopy of GST Certificate, Financial Soundness certificate issued by the bank certifying that the bidder has the capacity of paying the amount quoted in his/her bid as per his current bank balance or last six months transactions, Pan card, EPIC and Caste certificate of the bidder.
- The reserved price for 1 (oue) MT of the said coal is fixed at Rs. 2160/- (Rupees Two Thousand One Hundred Sixty) only being price fixed by the Mining and Geology Department.
- Intending bidder shall have to deposit a Non-refundable Earnest Money of Rs. 2000/- (Rupees Two Thousand) only by way of Bank Draft in favour of the Deputy Commissioner, West Jaintia Hills District, Jowai
- The intending bidder shall deposit Rs. 20, 000/- (Rupees Twenty Thousand) only a Refundable as earnest money in the form of deposit by way of Bank Draft in favour of Deputy Commissioner. West Jaintia Hills District, Jowai which is to be enclosed along with the bid. The earnest money shall be forfeited if the party/parties/bidder withdraws their/his bid/tender before the completion of the bidding process.
- The intending bidder, having produced copies of the Bank Draft towards payment of the Non- Refundable Earnest Money Deposit of Rs. 2.000/- (Two Thousand) and the Refundable Rs. 20, 000/- (Rupees Twenty Thousand) shall have to register their names with the Office of the Deputy Commissioner, West Jaintia Hills latest by 19th January, 2024 by 3:00 PM Copies of identity Card/EPIC will have to be furnished.
- The complete bid is to be submitted in a sealed envelope duly signed by the bidder and address to the office of the Deputy Commissioner, West Jaintia Hills District, Jowai on or before 19th January, 2024 by 3:00 PM The bids will be open in front of all bidders on the 22nd January, 2024 at 12:00 (Noon)
- Non-Tribal Bidders shall have to produce a valid Coal Trading License issued by JHADC, Jowai.
- On the date of opening of the bids only the registered in tending bidders shall alone be eligible to be present
- The successful bidder will have to deposit the total amount within 24 hours.
- In the event the successful bidder fails to pay the same within the stipulated time, the refundable money Rs. 20,000/- (Rupees Twenty Thousand) will be forfeited and the Deputy Commissioner, West Jaintia Hills will be at liberty to dispose of the coal again as deemed fit and proper.
- The successful bidder shall be liable to pay all custody payments. viz.. Royalty and other taxes as admissible to the Government. In the absence of the mandatory payments, no lifting of the said coal shall be permitted.
- Labour charges for lifting of the assigned/allotted coal shall be borne by the bidder/purchaser.
- The successful bidders shall dispose of the auctioned coal only after obtaining transport challan from the office of the Divisional Mining Office and on payment of relevant royalty and taxes as admissible.
- Upon payment of all Government dues pertaining to the allotted coal, the successful bidder shall lift the coal within 24 hours after the consignment/load has been weighed.
- The Undersigned reserves the right to cancel or postpone the Auction without assigning any reason(s) there upon. The decision of the Undersigned shall be final and binding and shall not be open to question.
