    In a major blow to the Indian National Congress party, Meghalaya Legislative Assembly Speaker Metbah Lyngdohon Thursday gifted a big Christmas bonanza to the Trinamool Congress Party by recognizing the merger of the 12 Congress legislators to the party and dismissed the Congress’s petition for their disqualification.

    According to Lyngdoh, On 29 November 2021, 10 (Ten) petitions were filed and submitted to him Dr. M. Ampereen Lyndoh, MLA against Dr. Mukul Sangma, MLA, Marthon Sangma, MLA, Jimmy D. Sangma, MLA, Lazarus M. Sangma, MLA, D. Shira. MLA, HM Shangpliang, MLA, George B. Lyngdah, MLA, Winnerson D Sangma, MLA, Dilkkanchi D. Shira, MLA Zenith M Sanga, MLA for disqualification under the Tenth Schedule to the Constitution of India.

    The petition is as per Rule 703b) of the Meghalaya Legislative Assembly (Disqualification on Ground of Defection) Rules, 1988.

    Subsequently, notices were issued from the Meghalaya Legislative Assembly Secretariat to the 10 (Ten) MLAs, namely Dr. Mukul Sangma, MLA, Shri Marthon Sangma, MLA , Jimmy D. Sangma, MLA, Lazarus M. Sangma, MLA, Miani D Shira, MLA, HM Shangpling, MLA Shri George B. Lyngdoh, MLA, Winnerson Sangma, MLA, Dikkanchi D. Shira, MLA and Shri Zenith M. Sangma, MLA using them to submit their comments on the pleadings in the petitions filed.

    Again, on 10 December, 2021, 2(Two) more partitions were file and submitted to him by Dr. M. Ampereen Lyndoh, MLA against Charles Pongrope, MLA and Shitlang Pale MLA for disqualification under the Tenth Schedule to the Constitution of India. Again as per Rule 7 (3)(b) of the Meghalaya Legislative Assembly (Disqualification on Ground of Defection) Rules, 1988 notices were issued from the Meghalaya Legislative Assembly Secretaria to the 2(Two) MLA, namely Charles Pyngrape, MLA and Shilang Pale, MLA asking them to submit their comments on the pleadings in the petitions filed.

    After examining in detail all the 12 (Twelve) petitions filed by the Petitioner Dr. M. Ampareen Lyngdoh, MLA, and the comments received from all the 12(Twelve) respondents, “I am satisfied that the merger of the 12 (Twelve) Members of the Indian National Congress is valid as provided under paragraph 4 of the Tenth Schedule to the Constitution of India,” said Meghalaya Legislative speaker, Metbah Lyngdoh.

    He also found that it does not attract disqualification and he does not find any merit in the submissive made in the petitions filed by Dr. M. Ampareen Lyngdoh, MLA, and therefore, the same is hereby dismissed.
